NEWS - Interim Approach to Impaired Driving

BC FlagPolice will revert to the previously used sanctions when a driver provides a breath sample at roadside that results in a fail reading due to the recent Supreme Court decision in Sivia v Superintendent of Motor Vehicles. The Superintendent has issued a document called the Interim Approach to Impaired Driving in BC to advise drivers how the process will be applied until formal terms of the court order are settled and changes are made to again apply the IRP process to drivers whose BAC exceeds .08.

The IRP process for drivers whose breath sample results in a warn remains the same.
