NEWS - ATV Deaths

ATVThe B.C. Coroner's Service has released statistics on All Terrain Vehicle (ATV) deaths in the province from 2009 to 2018. Impaired driving was involved in half of them.

CASE LAW - Passerin v Webb

BC Courts Coat of ArmsThis is a case where a runaway snowmobile collided with Angelo Passerin who had stopped to help another rider whose snowmobile was stuck in deep snow. In a way, this is an example of the perfect storm as the riderless snowmobile went over a 33 meter cliff, climbed out of a ravine and ran for more than a kilometer before striking Passerin.

Operation of Unlicensed Motor Vehicles

ATVIf it has a motor, gasoline or electric, and you operate it on a highway, chances are you need a driver's licence and the vehicle will need licence and insurance. There are very few exceptions to this rule.

While it may be convenient to take your quad to the community mailboxes instead of walking or driving your lawn tractor around the block because you cannot easily drive between the upper and lower parts of your yard it could be an expensive trip in the wrong circumstances.

How do I get Ownership Papers for my Snowmobile?

Q&A ImageI purchased a snowmobile in 2003 brand new from a Skidoo dealership in Kelowna. At that time I registered it with a ICBC and got a sticker. However, I never received any ownership papers. Is there any way to get that paperwork as I want to sell the machine.

Q&A - Displaying Off Road Vehicle Plate

Q&A ImageI have just received my new Off Road Vehicle (ORV) License Plate and I am having difficulty finding a place on the main frame to mount it. It is a Honda Rubicon TRX500 and the only place I could mount it with vee clamps is on the right side of the rear frame but it covers the tail light.

Off Road Vehicle Registration Required After June 1, 2015

Off Road Vehicle Licence PlateIf you intend to operate your off road vehicle (ORV) anywhere on public lands after June 1, 2015 you have just three weeks left to register it through ICBC. When the vehicle is registered an off road vehicle licence plate will be issued and must be displayed. The  changes replaced outdated legislation governing British Columbia’s growing off-road sector, and helps ensure these vehicles are driven in a safe and environmentally responsible manner. CASE LAW - Vance v Cartwright

BC Courts Coat of ArmsWilliam Vance was riding an unlicenced, uninsured off road motorcycle southbound on 198 Street in Langley, B.C. He was not wearing a helmet and was exceeding the speed limit. Cristine Cartwright was eastbound on 21 Avenue and had stopped at the stop sign before entering 198 Street intending to turn northbound. Vision was limited for drivers on 21 avenue looking northbound by roadside vegetation.

CASE LAW - Taylor v Depew

BC Courts Coat of ArmsCan you spare $206,333.05? This is the amount that the defendant, Matthew Depew, has been required to pay Sean Taylor for damages suffered in an off road collision. Mr. Taylor was riding a motorcycle in poor repair and Mr. Depew was driving a dune buggy on a single lane dirt forest road serving a forest service camp site near Campbell River, BC. Although the judgment does not say so, I suspect that there won't be any insurance coverage to help Mr. Depew pay the bill.

Q&A - Quads Prohibited from Using Some Forest Service Roads?

ATVCould you please touch on where a quad or off road machine may and may not operate. We were on the Gillard FSR and a police car had a side by side pulled over. We did not stop and ask what was going on. I understand that certain parts of the KVR are OK and some not...very confusing.
