I have a question about the demerit point system and prohibition.
I'm currently in the Novice stage and I have already had my license suspended previously. I was given my first ticket just a little over a year ago in August of 2009. The ticket totalled 6 demerit points and my license was suspended for 90 days in October of 2009. I had my license reinstated in February of 2010, and I paid off the 3 remaining demerit points ($300), in May of 2010. I was given a ticket in August of 2010, which totals 3 demerit points. Will I be automatically prohibited again? Or will I have to accumulate more points as the two violation tickets were issued in two separated "assessment periods" (my birthday is in May, so the two separate assessment periods would be between December 2008-December 2009, and December 2009-December 2010.
Thanks.
The Superintendent of Motor Vehicles ultimately decides on prohibitions like this and he follows the guidelines set out in the Policies and Guidelines of the Driver Improvement Program.
You appear to fall under 4.3 New Drivers - With Previous Prohibitions within 2 Years. It appears that you can expect a prohibition of between 2 and 9 months once you either pay or are convicted of the August 2010 ticket.
The penalty point assessment periods don't play any part in this decision.
Thanks for the quick response.
How long should I expect to be suspended? I was put through a 90 day suspension previously.
I can't say anything more than the 2 to 9 months specified in the document. You'll have to wait for the Superintendent's decision.
