In this case the product is a restraint for our canine friends when they ride in our vehicle with us. The claim is that the restraints will protect the animal. CBC Marketplace testing finds the contrary, our expectations may be putting both our pets and ourselves at risk.

CASE LAW - Ziemer v Wheeler

BC Courts Coat of ArmsHarris Wheeler was driving northbound on Highway 97 south of Taylor, B.C. when his vehicle collided with a moose. Shortly afterward Aron Walter, driving southbound, struck that moose which was then laying on the highway. That collision caused his vehicle to cross over the center line where he struck a vehicle driven by Raymond Ziemer head on.

Today while out walking during my lunch hour I watched a woman jogging with her back to traffic, in the lane instead of on the sidewalk, while wearing earbuds. A van squeezed between me and the curb as I crossed an intersection on the walk to my vehicle to get home. Are you surprised that these collisions are occurring?

The headlight is pointing at the sky, the signal light is missing and the bumper had to be removed so that the tire has room to steer. The appointment with an insurance adjuster is pending, and you can’t even think about the body shop yet. Can you just keep driving until the vehicle is repaired?

CASE LAW - Link v ICBC

BC Courts Coat of ArmsPeter Link was driving to White Rock from Richmond on an evening with 2 to 3 inches of new snow. On highway 99 between the highway 10 and highway 91 exits he was passed by an unidentified SUV. The SUV moved into Link's lane after passing at such a short distance that his windshield was completely covered by snow thrown up by the SUV's wheels making it impossible to see. Mr. Link braked, spun out of control and collided with the cable barrier in the center median. This court case determined that the SUV driver was negligent and responsible for the collision, not Mr. Link.
