CASE LAW - Nonis v Granata

BC Courts Coat of ArmsThis case determines liability following a collision that took place between vehicles driven by Claudio Nonis and Stefano Granata at the intersection of Hastings Street and Madison Avenue in Vancouver, B.C.

Mr. Granata was traveling on Hastings Street approaching Madison Avenue and facing a flashing green traffic signal.

Mr. Nonis was traveling on Madison, crossing Hastings after stopping at a posted stop sign.

The discussion of the duty of both drivers when encountering each other in the presence of the traffic controls described is interesting. Both had duties of care in the circumstances and these were considered in apportioning blame 75% to Mr. Nonis and 25% to Mr. Granata.
