CASE LAW - Jaura v Rosal

BC Courts Coat of ArmsThe case of Jaura v Rosal involves a right angle collision at the intersection of Inverness Street and 49th Avenue in Vancouver. Traffic on 49th Avenue was stopped bumper to bumper in both directions and Ms. Jaura had stopped at the stop sign northbound on Inverness Street. She intended to travel straight through the intersection.

Mr. Arcilla was stopped in traffic westbound on 49th Avenue in the inside lane, also intending to travel straight through the intersection. He was at the front of traffic waiting for the red light at the intersection.

Ms. Jaura began to cross 49th Avenue when Mr. Arcilla moved ahead and collided with her vehicle's passenger door.

Mr. Justice Caldwell found that regardless of the state of the traffic light for travel on 49th Avenue, had Mr. Arcilla checked to his left before proceeding the collision would have been avoided. He found Mr. Arcilla 100% at fault for the collision.
