CASE LAW - McKenna v Andrews

BC Courts Coat of ArmsCody Andrews and Barry McKenna were driving northbound on Highway 1 between Hutchinson and Chapman Roads in Cobble Hill. Mr. McKenna was operating a motorcycle in the left lane intending to make a left turn onto Hutchinson and Mr. Andrews was driving his sportscar in the right lane. When Mr. Andrews moved to the left lane, they collided.

Both drivers blamed the other for the collision, Mr. Andrews saying that the motorcycle changed lanes in front of him too closely and Mr. McKenna saying that the car hit him while making a lane change.

Mr. Justice Sewell examined the circumstances in light of section 151 MVA that governs driving on laned roadway. He found Mr. Andrews fully at fault for the collision as he had failed to keep a proper lookout and changed lanes, hitting the motorcycle.
