CASE LAW - Rothenbusch v Van Boeyen

BC Courts Coat of ArmsMany drivers would never consider that they might have a duty to yield to a vehicle at a stop sign and let them enter the highway. This case involves assigning liability after a collision that took place at a "T" intersection. One driver had stopped, noted traffic at a distance that did not appear to be a hazard and began to make a turn to enter the cross street. That traffic turned out to be another driver in a big hurry that stuck the emerging vehicle and was found to be at fault for doing so.
