Question: On my way home from dropping my daughter at school I make a left turn onto my street at an intersection and then need to turn left immediately again as my house is the 1st driveway. I do so over a single yellow line and am often getting honks etc.
I was issued a ticket two weeks after my accident for "failure to keep right." It was delivered to my home by two officers from the detachment in the city I live in. The officer that attended the accident scene was from a detachment equal distance away from the accident.
I found your article that explains the Motor Vehicle Act (MVA) requires that the JP impose the fine legislated for the speed being travelled. If they find between 20 and 40 over, for instance, they must impose the $196 fine and cannot reduce it. I am not able to find where the MVA says that speeding fines can't be reduced.
Question: The police officer used a radar gun to check my speed. According to him, there are no records for radar calibration on it. This is a real, live issue for my trial. If the radar gun does not have service records, then how do we know that it is functioning correctly?
Question: I had a clean driving record until last week when I received my first ticket in 41 years of driving. I had recently started driving taxi part time and at the end of a 9 hour shift I dropped the taxi off and got into my own car. Five minutes later I went through a school zone without slowing down, having missed the school zone sign.
My question regards the right of way of pedestrians who are in the roadway illegally, i.e. they have disobeyed a control signal or have failed to yield to traffic as per section 180. The thought came to me after watching a YouTube clip from the United Kingdom, intended to illustrate proper horn use.
Question: I would like to know about the requirement for winter tires on recreational trailers from October 1 to March 31 on B.C. highways. As far as I'm aware, I'm required to have snowflake / M+S tires in winter on my travel trailer, but such tires are not made. Can you please advise me on this situation?
Question: Is there a minimum speed limit on municipal roads? For example, if a road has a designated speed limit of 50 km/h, is there an inferred or statutory minimum speed for that road? The reason I ask is because my 17 year old daughter recently failed her driver's test. The reason? "Driving too slow."
Question: I've been living in the Armstrong Elementary school area for the last 1.5 years and I have never seen any speed enforcement taking place in the school zone on Rosedale Avenue or Pleasant Valley Road. It's beginning to feel like I'm the only one who knows the speed limit is 30 km/h. Is it as simple as calling the RCMP and requesting that they do enforcement here?
My question is regarding the right of way at a regular two way stop sign. I've heard that once I have stopped at the sign, cross traffic is required to let me enter the intersection. I've never seen anyone do this.
